Active & Ageless Pty Ltd (ABN 83 645 759 397) ("Active & Ageless", “we”, “our”, “us”) operates health clubs, services and the website activeandageless.com.au ("Site") and associated mobile application ("App"). We are committed to protecting your privacy in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).

1. Scope

This Privacy Policy explains how we collect, hold, use and disclose personal information when you interact with our gyms, Site and App, book a class, purchase a membership or otherwise engage with us.

2. What information we collect

We may collect the following categories of information:

  • Identity & Contact - name, date of birth, postal address, email, phone number, emergency contact

  • Demographic - age range, gender, occupation

  • Health & Fitness (sensitive information) - pre‑exercise questionnaires, medical conditions, injuries, movement screening results, heart‑rate and other biometric data

  • Membership & Transaction - membership tier, payment history, billing details, concession status

  • Technical & Usage - IP address, device identifiers, browser type, pages viewed, session time, App usage

  • Marketing Preferences - opt‑ins/opt‑outs to receive news, offers, or event information

3. How we collect information

Directly from you when you complete forms online or in‑club, make enquiries, attend classes, enter promotions, or communicate with our staff.Automatically via cookies, log files and similar technologies when you visit the Site or use the App.Third parties such as payment processors, health professionals (with your consent), or marketing/analytics providers.

You may choose to interact with us anonymously or under a pseudonym where practicable, but some services (e.g., membership) cannot be provided without identifying information (APP 2).

4. Why we collect, hold and use your information

We use your personal information to:

  1. register and manage memberships, bookings and payments;

  2. design and deliver safe exercise programs tailored to you;

  3. operate, maintain and improve our clubs, Site and App;

  4. verify your identity and age eligibility (over 50s club);

  5. send service communications (e.g., booking confirmations, timetable changes);

  6. conduct marketing, promotions and surveys (you may opt out at any time – see § 8);

  7. comply with legal obligations (e.g., workplace health & safety, taxation, reportable incidents);

  8. prevent, detect and investigate misuse, fraud or security breaches.

5. Disclosure of personal information

We only disclose information for the purposes outlined above to:

  • service providers under contract (e.g., cloud hosting, payment gateways, mailing platforms, IT support);

  • professional advisors (accountants, lawyers, insurers);

  • health practitioners or emergency services where reasonably necessary to protect your vital interests;

  • government agencies, regulators or courts where required or authorised by law.

Some suppliers are located outside Australia (including but not limited to the United States and the European Union). Where we transfer personal information overseas, we take reasonable steps to ensure that the recipient complies with privacy obligations substantially similar to the APPs (§ APP 8).

6. Data security

We employ administrative, technical and physical safeguards (including encryption in transit, password policies, restricted access and staff training) to protect personal information from misuse, interference, loss, unauthorised access, modification or disclosure (APP 11).

7. Data retention & destruction

We only keep personal information for as long as reasonably necessary for the purposes described or as required by law (e.g., tax or health‑record retention obligations). When no longer needed, we securely destroy or de‑identify the information.

8. Direct marketing & cookies

We may send you fitness tips, event invitations and promotional offers via email, SMS or push notifications in accordance with the Spam Act 2003 and APP 7. You can opt‑out at any time by clicking ‘unsubscribe’ in a message, adjusting your App settings or contacting us.Our Site uses first‑ and third‑party cookies and analytics tools (e.g., Google Analytics) to understand user behaviour and improve performance. You may disable cookies in your browser, but some features may not work.

9. Access & correction

You may request access to, or correction of, the personal information we hold about you by contacting us (see § 12). We will respond within a reasonable period and give you access unless an exception applies (APPs 12 & 13).

10. Complaints

If you believe we have breached the APPs, please contact us in writing. We will acknowledge receipt, investigate and respond. If you are dissatisfied, you may refer your complaint to the Office of the Australian Information Commissioner (OAIC) (oaic.gov.au).

11. Changes to this Privacy Policy

We may amend this Privacy Policy from time to time. The updated version will be posted on the Site with the effective date. Continued use after changes indicates acceptance.
